The author outlines the recent changes to Japanese law and transplant policy that allow for organ procurement after brain death with only family consent (previously there had to also be prior written consent from the donor). As well, the new Japanese law allows donors to prioritize family members to receive their organs after brain death, and the article examines whether this policy comprises fairness in the allocation of deceased donor organs. This is an interesting piece, especially considering the long held beliefs of the Japanese public towards the concept of brain death. It will be interesting to see how this new policy plays out in practice.
